These Terms of Service govern your use of beacrab.com and any purchase you make from us.
Please read these Terms carefully before using our website or placing an order. By using our website or submitting an order, you agree to these Terms.
Nothing in these Terms affects your statutory rights as a consumer.

In these Terms, “Be A Crab”, “The Shell Club”, “we”, “us” and “our” refer to Be A Crab LTD.
Our online store is hosted by Shopify, which provides the ecommerce platform through which we offer our products.

These policies should be read together with these Terms.
If there is any conflict between these Terms and our Returns & Refunds Policy concerning a return or refund, the Returns & Refunds Policy will apply, subject always to your statutory rights.
3. Who may place an order
You must be at least 18 years old and legally capable of entering into a binding contract to place an order through our website.
By submitting an order, you confirm that:
- You are at least 18 years old
- The information you provide is complete and accurate
- You are authorised to use the selected payment method
- You are purchasing for lawful purposes
We may refuse or cancel an order where we reasonably believe that these requirements have not been met.
4. Website information
We take reasonable care to ensure that information displayed on our website is accurate.
However:
- Product images are for illustrative purposes
- Colours may appear differently depending on your device and display settings
- Product measurements may be approximate
- Packaging may vary
- Minor variations may occur between products
- Website information may occasionally contain typographical or technical errors
These points do not affect your rights where a product is faulty, materially different from its description or otherwise does not comply with applicable consumer law.
5. Product availability
All products are subject to availability.
Adding a product to your basket does not reserve it.
If a product becomes unavailable after you place an order, we may:
- Contact you to offer an alternative
- Dispatch the available products and refund the unavailable products
- Cancel the affected part of the order
- Cancel the entire order where appropriate
We will refund any amount paid for products that we cannot supply.
6. Placing an order
Our checkout process allows you to review and correct your order before submitting it.
You are responsible for checking:
- The products selected
- Quantities
- Sizes and colours
- Personalisation details, where applicable
- Gift-card value, recipient details and personal message, where applicable
- Billing information
- Delivery information
- Contact details
- Delivery method
- Total price
After you submit an order, we will send an order-confirmation email acknowledging that we have received it.
The acknowledgement email does not necessarily mean that we have accepted your order.
7. When the contract is formed
For physical products, a legally binding contract between you and us is normally formed when we send confirmation that your order has been dispatched.
For a digital gift card, a legally binding contract is normally formed when we send confirmation that the gift card has been issued or made available.
Until that point, we may decline or cancel an order for a legitimate reason, including:
- A product being unavailable
- Payment not being authorised
- Incorrect pricing or product information
- Suspected fraud or unauthorised activity
- Delivery restrictions
- A breach of these Terms
- An error affecting our ability to fulfil the order
- An order being placed for unlawful or improper purposes
If we cancel an order after taking payment, we will refund the affected amount to the original payment method.
8. Order limits and resale
Products sold through our website are primarily intended for personal use.
We may refuse, limit or cancel orders that reasonably appear to be:
- Placed for unauthorised resale
- Abnormally large
- Duplicated
- Placed using automated methods
- Intended to exploit a pricing, discount or website error
- Connected with suspected fraud or misuse

9. Prices
Prices are displayed in the currency shown at checkout.
Unless stated otherwise, prices include applicable UK VAT.
Delivery charges and any other applicable charges will be shown before you submit your order.
We may change prices at any time, but changes will not normally affect an order that we have already accepted.
10. Pricing and website errors
Despite our reasonable efforts, a product may occasionally be listed with an incorrect price, description, discount or availability status.
Where an error is obvious and could reasonably have been recognised as an error, we are not required to supply the product on the incorrect terms.
If we identify an error before accepting your order, we may:
- Contact you and ask whether you wish to proceed on the corrected terms
- Cancel the affected product
- Cancel the order
If we cannot contact you, we may treat the affected order as cancelled.
Any payment collected for a cancelled product will be refunded.
11. Discount codes and promotions
Discount codes and promotional offers are subject to any conditions stated with the offer.
Unless stated otherwise:
- Codes cannot be exchanged for cash
- Codes cannot be applied retrospectively
- Only one code may be used per order
- Codes may have expiry dates
- Certain products may be excluded
- Minimum-spend requirements may apply
- Codes may be limited to one use per customer
- Codes may not be combined with other offers
We may withdraw or correct a promotion where there has been an error, misuse, fraud or circumstances outside our reasonable control.
This does not affect orders that have already been validly accepted, except where an obvious error or misuse has occurred.
12. Payment
Available payment methods will be displayed at checkout and may include:
- Debit cards
- Credit cards
- Digital wallets
- Be A Crab gift cards or store credit, where available
- Shopify-supported payment methods
- Other payment providers made available through the website
Payment will normally be authorised or taken when you place your order.
Payment being taken does not by itself mean that the order has been accepted.
You must provide accurate payment information and have permission to use the selected payment method.
Payment providers may carry out:
- Authorisation checks
- Fraud screening
- Address verification
- Identity or security checks
We are not responsible for a payment being declined by your bank, card issuer or payment provider.
13. Delivery
Delivery options, estimated times and charges are explained in our Delivery Policy and displayed at checkout where applicable.
Please ensure that your delivery address is complete and accurate.
Estimated delivery dates are estimates rather than guaranteed dates unless we expressly agree otherwise.
We will take reasonable steps to deliver within the stated timeframe. Where no specific timeframe has been agreed, goods will normally be delivered without undue delay and within the period required by law.
14. Delivery delays
We are not responsible for delays caused by circumstances outside our reasonable control.
These may include:
- Courier disruption
- Severe weather
- Customs delays
- Transport disruption
- Industrial action
- Natural disasters
- Government restrictions
- Supply-chain interruption
- Security incidents
- Incorrect or incomplete customer information
If a significant delay occurs, we will take reasonable steps to inform you.
Where the delay gives you a legal right to cancel, you may exercise that right by contacting sales@beacrab.com.
15. Missed or unsuccessful delivery
If no one is available to accept delivery, the courier may:
- Leave the parcel in an authorised safe place
- Leave it with a neighbour where permitted
- Attempt redelivery
- Take it to a collection point
- Return it to us
You are responsible for following the courier’s reasonable instructions regarding collection or redelivery.
If an order is returned to us because:
- The address provided was incorrect or incomplete
- Delivery was repeatedly refused
- The parcel was not collected
- Redelivery was not arranged
we may contact you to arrange redelivery.
We may charge a reasonable additional delivery cost where the failed delivery resulted from information or circumstances within your control.
Alternatively, we may cancel and refund the order. Any deduction must be lawful, reasonable and reflect costs actually incurred.
16. When responsibility for products passes to you
The risk of loss or damage normally passes to you when the products are physically delivered to:
- You
- A person identified by you to receive them
- A safe place expressly authorised by you
Risk does not normally pass merely because a delivery attempt has been made.
Where you independently arrange a carrier that was not offered or nominated by us, risk may pass when the products are delivered to that carrier, as permitted by law.
Ownership of the products passes to you once we have received payment in full.
17. Checking your delivery
Please inspect your order as soon as reasonably possible after delivery.
Contact us promptly if:
- A product is missing
- The wrong product was supplied
- The parcel appears damaged
- A product is damaged
- The delivery has not arrived
Prompt notification helps us investigate the issue with the courier, but failure to notify us within 24 hours does not automatically remove your statutory rights.

- Your order number
- A description of the issue
- Photographs where relevant
- Photographs of the packaging where relevant
18. Delivery shown as completed but not received
If tracking shows that an order was delivered but you cannot locate it, please:
- Check the delivery address on your order
- Check any nominated safe place
- Ask members of your household
- Check with neighbours
- Review any courier photograph or delivery notice
Then contact us promptly at sales@beacrab.com.
We may ask you to provide information reasonably required to investigate the delivery with the courier.
19. Cancelling before dispatch
You may ask us to cancel an order before it is dispatched by contacting sales@beacrab.com.
We will try to process the request, but we cannot guarantee cancellation once warehouse processing has begun.
A stated one-hour cancellation period is operational guidance only and does not limit any statutory cancellation rights you may have.
If the order cannot be stopped, you may return eligible products after delivery in accordance with our Returns & Refunds Policy.
20. Statutory cancellation rights
UK consumers purchasing online normally have the right to cancel most orders without giving a reason.
The statutory cancellation period normally ends 14 days after the day on which:
- You receive the goods
- A person nominated by you receives the goods
- You receive the final product where one order is delivered separately
- You receive the final part where a product is delivered in multiple parts
To exercise this right, you must clearly tell us that you wish to cancel.

You do not need to use any particular wording, but you should provide enough information for us to identify your order.
21. Our extended 30-day returns policy
In addition to statutory rights, we offer eligible customers a 30-day returns period, subject to the conditions in our Returns & Refunds Policy.
Under our extended policy, returned products must generally be:
- Unused
- Unworn
- Unwashed
- In their original condition
- Returned with all original tags attached
- Free from marks, stains, odours, pet hair or signs of use
You may carefully inspect or try on a product indoors as you would in a shop.
Products must not be worn outdoors or used for several days before being returned.
Full conditions are set out in our Returns & Refunds Policy.
22. Free returns
For eligible UK returns, we will provide a prepaid return method in accordance with our Returns & Refunds Policy.
You must use the return method provided or approved by us.
We cannot guarantee reimbursement of independently arranged return postage unless we agreed to it in advance.
Please retain proof of postage until your refund has been completed.
23. Refunds
Approved refunds will normally be issued to the original payment method.
Where an order was paid wholly or partly using a Be A Crab gift card, the amount paid by gift card will normally be returned to the same gift-card balance.
Any amount paid using another payment method will normally be returned to that original payment method.
Refunds will be processed within the period stated in our Returns & Refunds Policy and no later than required by law.
Your bank, card issuer or payment provider may require additional time to display the refund.
Where required by law, a full-order cancellation will include the cost of our least expensive standard outbound delivery method.
Additional charges for express, premium or nominated-day delivery may not be refundable beyond the standard-delivery amount.
24. Deductions from refunds
Where legally permitted, we may reduce a refund to reflect a loss in value caused by handling beyond what was reasonably necessary to inspect the product.
Examples may include:
- Wearing a product outdoors
- Extended use
- Washing or cleaning
- Alteration
- Damage
- Marks or stains
- Strong odours
- Pet hair
- Missing components
- Missing accessories
- Damaged or missing packaging where this materially reduces value
- Removal of tags under our extended returns policy
Any deduction will be reasonable and based on the reduction in the product’s value.
Nothing in this section limits your rights where a product is faulty, damaged, incorrectly supplied, not as described or not fit for purpose.
25. Products excluded from change-of-mind returns
Unless faulty or otherwise covered by statutory rights, the following may be excluded from our extended change-of-mind returns policy:
- Personalised products
- Custom-made products
- Products made to individual specifications
- Gift cards that have been redeemed or partially redeemed
- Sealed products that are unsuitable for return for health-protection or hygiene reasons once unsealed
- Products that have been worn, washed, used, altered or damaged
- Products returned outside the applicable returns period
Any product-specific restriction will be stated on the relevant product page where appropriate.
26. Personalised and custom-made products
Please check all personalisation and customisation information carefully before submitting an order.
We are not responsible for errors resulting from information supplied by you, including:
- Incorrect names
- Incorrect wording
- Spelling errors
- Incorrect dimensions
- Incorrect colour selections
- Incorrect design choices
Once production has started, a personalised or custom-made order may not be capable of amendment or cancellation.
This does not affect your rights where the product is faulty, not as described or not produced in accordance with the agreed specification.
27. Faulty or misdescribed products
We are under a legal duty to supply products that comply with the contract.
Products must be:
- Of satisfactory quality
- Fit for their usual purpose
- Fit for any particular purpose agreed with us
- As described
- Consistent with any approved sample or model where applicable
If you believe a product is faulty, damaged, incorrect or misdescribed, contact sales@beacrab.com.
Please include:
- Your order number
- A description of the issue
- Photographs where appropriate
Depending on the circumstances and your statutory rights, a remedy may include:
- Repair
- Replacement
- Price reduction
- Refund
We may inspect the product or request further reasonable information before confirming the appropriate remedy.
28. Two-year limited warranty for bags
In addition to your statutory rights, all bags purchased from us include a two-year limited warranty beginning on the date of delivery.
This commercial warranty applies only to bags and covers manufacturing defects in materials or workmanship arising under normal and intended use.
Covered manufacturing defects may include:
- Faulty or broken zips caused by a manufacturing defect
- Stitching that is incorrectly sewn
- Stitching that comes apart because of a manufacturing defect
- Manufacturing defects affecting straps
- Manufacturing defects affecting handles
- Manufacturing defects affecting seams
- Manufacturing defects affecting closures
- Structural manufacturing defects
A problem will not necessarily qualify merely because it occurs within two years. We may inspect the bag to determine whether the issue resulted from a manufacturing defect.
29. Warranty exclusions
The two-year bag warranty does not cover:
- Normal wear and tear
- Natural fading
- Fabric softening
- Material ageing
- Surface wear caused by ordinary use
- Overloading
- Misuse
- Accidents
- Impact damage
- Neglect
- Scratches
- Scuffs
- Dents
- Marks caused during use
- Improper cleaning
- Improper storage
- Exposure to unsuitable or extreme conditions
- Damage caused by animals
- Damage caused by sharp objects
- Unauthorised alterations
- Repairs or modifications carried out by third parties
- Damage caused by failing to follow care instructions
- A product reaching the end of its reasonable natural lifespan
The bag should be reasonably clean and made available for inspection.
Proof of purchase is required.
30. Warranty remedies
Where a valid warranty claim is accepted, we may offer:
- A repair
- A replacement
- An appropriate refund
The suitable remedy will depend on:
- The nature of the defect
- The age of the product
- Product availability
- Whether repair is possible
- The applicable statutory rights
The two-year limited warranty is additional to, and does not replace or restrict, your statutory consumer rights.
31. Product care
You should follow any care instructions supplied with a product or displayed on the relevant product page.
Damage caused by unsuitable cleaning, storage, handling or use may not qualify as a manufacturing defect.
Product-care requirements do not affect your rights where a product was faulty when supplied.
32. Gift cards
This section applies to Be A Crab gift cards issued through our website.
Gift cards are normally supplied digitally. No physical card will be posted unless the relevant product page expressly states otherwise.
Gift cards may be purchased for yourself or sent to another person.
Where you provide recipient details, you are responsible for checking that the recipient’s name and email address are complete and accurate before submitting the order.
Gift-card delivery
Digital gift cards are sent electronically to the email address selected during purchase or otherwise made available through the method described at checkout.
Delivery times shown for digital gift cards are estimates. Automated emails may occasionally be delayed by email filtering, technical problems or incorrect recipient information.
The purchaser or recipient should check spam and junk folders before contacting us about a missing gift-card email.
If you provide an incorrect recipient email address, contact sales@beacrab.com promptly.
We will try to help, but we cannot guarantee that a gift card can be redirected, cancelled or replaced after it has been delivered or redeemed.
Gift-card use
Unless stated otherwise when issued, a Be A Crab gift card:
- May be redeemed through beacrab.com
- May be used towards eligible products available at checkout
- Is issued in pounds sterling
- May be used over more than one transaction while a balance remains
- May be combined with another supported payment method where the order total exceeds the available balance
- Cannot normally be exchanged for cash
- Cannot normally be used to purchase another gift card
- Cannot be applied retrospectively to an order that has already been completed
- Must not be resold or transferred for commercial purposes without our written permission
Any unused balance will remain linked to the original gift-card code.
No expiry date
Be A Crab gift cards do not currently expire.
If we introduce expiry dates for future gift cards, any expiry date will be clearly disclosed before purchase and will not retrospectively reduce the validity of a gift card already issued without an expiry date.
Keeping gift cards secure
Gift-card codes should be treated like cash.
The purchaser and recipient are responsible for keeping the code secure and for sharing it only with the intended recipient.
We are not responsible for unauthorised use where a valid code has been disclosed, forwarded, published, lost or inadequately protected, unless the loss or unauthorised use resulted from our fault or another legal remedy applies.
If you believe a gift card has been lost, stolen, compromised or used without permission, contact sales@beacrab.com promptly.
We may ask for the purchaser’s name, order number, email address and other information reasonably required to verify ownership and investigate the issue.
We may temporarily suspend or deactivate a gift card where we reasonably suspect fraud, misuse, unauthorised access, a payment dispute or a security risk.
Resending or replacing a gift card
If a gift-card email has been accidentally deleted or cannot be located, we may be able to resend the gift-card information after appropriate security checks.
Resending a gift-card email does not create additional value or a second gift card.
We cannot guarantee replacement of value that has already been redeemed using a valid code.
Cancellations and refunds
A gift card that has been redeemed or partially redeemed cannot normally be cancelled or refunded simply because the purchaser or recipient has changed their mind.
For an unused gift card purchased online, any statutory cancellation rights that apply remain unaffected.
Contact sales@beacrab.com promptly if you wish to request cancellation.
Where legally permitted, we may deactivate the gift card before approving a refund.
An approved refund for the purchase of a gift card will normally be returned to the original payment method used to buy it.
Where a product purchased using a gift card is validly returned, the amount originally paid by gift card will normally be returned to the same gift-card balance.
Any remaining refundable amount will normally be returned to the other original payment method.
Faulty or incorrectly issued gift cards
Contact us promptly if:
- The gift-card code does not work
- The wrong value was issued
- The gift card was sent to the wrong address because of our error
- The gift card was not supplied as described
- The available balance appears incorrect
We will investigate and provide an appropriate remedy where required.
Fraud and misuse
We may refuse, cancel, suspend or deactivate a gift card or related order where we reasonably believe that it:
- Was obtained through fraud or an unauthorised payment
- Is connected with a chargeback or reversed payment
- Has been altered, duplicated or manipulated
- Is being used unlawfully
- Is being used to exploit a technical, pricing or promotional error
- Is connected with abusive, automated or suspicious activity
Where possible and appropriate, we will contact the purchaser or account holder before taking action.
Nothing in this section excludes or restricts your statutory rights.
33. Customer accounts
You may be able to create an account through our website.
You are responsible for:
- Providing accurate account information
- Keeping your password secure
- Restricting access to your device
- Notifying us of suspected unauthorised access
We may suspend or close an account where reasonably necessary because of:
- Fraud
- Security concerns
- Misuse
- Illegal activity
- Repeated breach of these Terms
Account closure does not affect existing payment obligations or rights relating to completed orders.
34. Reviews and customer content
Where our website allows you to submit reviews, photographs, comments or other content, you must ensure that the content:
- Is truthful
- Relates to your genuine experience
- Is not unlawful
- Is not threatening or abusive
- Is not defamatory
- Does not infringe intellectual-property rights
- Does not contain malicious software
- Does not contain another person’s private information without permission
- Is not misleading or fraudulent
You retain ownership of your content.
By submitting content for publication, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, display and adapt it for operating and promoting our business, subject to applicable law and our Privacy Policy.
We may moderate or remove content where reasonably necessary, but we are not obliged to publish every submission.
35. Intellectual property
All intellectual-property rights in our website and its content belong to us or our licensors.
This includes, where applicable:
- Brand names
- Logos
- Product photographs
- Product designs
- Graphics
- Text
- Videos
- Website layout
- Software
- Illustrations
- Marketing materials
You may use the website for personal and non-commercial shopping purposes.
You must not, without permission:

- Reproduce product images for commercial purposes

Loss or damage is foreseeable where:
- It was an obvious consequence of our breach
- You and we contemplated it when the contract was formed
We are not responsible for loss or damage that was not foreseeable.
39. Business losses
Our products are primarily supplied for private and domestic use.
Where you use a product for commercial, business or resale purposes, we will not be responsible, to the extent permitted by law, for:
- Loss of profit
- Loss of revenue
- Loss of business
- Loss of anticipated savings
- Business interruption
- Loss of commercial opportunity
Nothing in this section affects liability that cannot legally be limited.
40. Liability that is not excluded
Nothing in these Terms excludes or limits liability for:
- Death or personal injury caused by negligence
- Fraud
- Fraudulent misrepresentation
- Breach of rights that cannot lawfully be excluded
- Defective products where liability cannot legally be excluded
- Any matter for which exclusion or limitation would be unlawful
Nothing in these Terms excludes or restricts your statutory consumer rights.
41. Events outside our reasonable control
We will not be responsible for delay or failure caused by an event outside our reasonable control.
Such an event may include:
- Natural disaster
- Severe weather
- War
- Terrorism
- Civil unrest
- Epidemic or pandemic
- Government action
- Transport disruption
- Industrial action
- Utility failure
- Internet or communications outage
- Cyberattack
- Supplier or courier failure outside our reasonable control
We will take reasonable steps to reduce the effects of the event and resume performance where possible.
Where the event causes substantial delay, you may have the right to cancel the affected order.
42. Personal information
We process personal information in accordance with our Privacy Policy and Cookie Policy.
This includes information used to issue, deliver, administer, redeem, refund, secure or investigate gift cards.
Where you provide another person’s details so that we can send them a gift card, you should ensure that you are entitled to provide those details and that they are accurate.
By using our website, you acknowledge that your information may be processed by service providers needed to operate the website, take payments, fulfil orders, issue and administer gift cards, provide support and perform other functions described in those policies.

We will ensure that any transfer does not reduce your rights under the contract.
You may only transfer your rights or obligations with our written consent, except where the law allows otherwise.
45. No rights for third parties
The contract is between you and Be A Crab LTD.
No other person has the right to enforce its terms unless applicable law provides otherwise.
46. If part of these Terms is invalid
Each section of these Terms operates separately.
If a court or relevant authority decides that any part is unlawful or unenforceable, the remaining sections will continue in effect.
47. Delay in enforcement
If we do not immediately enforce a right under these Terms, that does not mean that we have waived it.
A waiver will only apply where we clearly agree to it.

We may update these Terms from time to time because of:

These Terms and any contract between you and us are governed by the laws of England and Wales.
If you are a consumer living in another part of the United Kingdom, you may also benefit from the mandatory consumer protections and court rights applicable where you live.

Nothing in these Terms restricts any right you have to use the courts of Scotland or Northern Ireland where applicable.
